Why Trademark Protection Matters for Every Founder
Your brand name, logo, slogan, and packaging design are your company’s most valuable intellectual property assets. Without a registered trademark, you risk copycats, cease-and-desist notices, and irreversible loss of customer goodwill. Once your trademark application is submitted, you can instantly use the ™ symbol; upon final registration, you earn the coveted ® seal.
Understanding the 45 Trademark Classes
India follows the international Nice Classification system consisting of 45 distinct classes:
- Classes 1 to 34: Physical Manufactured Goods (e.g., Class 9 for Software & Tech Hardware, Class 25 for Apparel, Class 5 for Pharmaceuticals).
- Classes 35 to 45: Services (e.g., Class 35 for E-Commerce & Advertising, Class 36 for Fintech & Real Estate, Class 42 for SaaS & Cloud Development).
The Step-by-Step Trademark Journey
- Comprehensive Public Search: Check the IP India portal to verify that no phonetically or visually identical marks exist in your target classes.
- Form TM-A Filing: File the application online with user affidavit, logo representation, and MSME/Startup certificate for fee discounts.
- Examination Report: An IP India examiner reviews the mark within 1–2 months. If compliant, it moves to journal publication; if objections are raised under Section 9 or 11, a written reply must be filed within 30 days.
- Publication in Trademark Journal: The mark is advertised for a statutory 4-month opposition period for third-party scrutiny.
- Registration Certificate: If no oppositions are raised, the registration certificate is granted for 10 years, renewable indefinitely.
